1. Introduction & Acceptance of Terms

Welcome to MagikVid (https://magikvid.com). By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you ("User", "you") and MagikVid ("we", "us", "our"). We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any modifications.

2. Service Description

MagikVid is an AI-powered video generation platform that allows users to create videos from static images. Our services include, but are not limited to:

  • AI image-to-video generation
  • Voice synthesis and lip-sync capabilities
  • Video customization through text prompts
  • A credit-based usage system for video generation

The Service relies on third-party AI models and infrastructure. We do not guarantee uninterrupted availability, specific output quality, or that the AI will produce results matching your exact expectations.

3. Account Registration & Security

To use the Service, you must create an account by providing a valid email address and password, or by authenticating via Google OAuth. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security and confidentiality of your login credentials
  • Notify us immediately of any unauthorized access to your account
  • Accept full responsibility for all activities that occur under your account

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

4. Subscription & Billing

MagikVid offers subscription plans on a monthly or annual billing cycle. By subscribing, you agree to the following:

  • Auto-renewal: Subscriptions automatically renew at the end of each billing period (monthly or annually) unless cancelled before the renewal date.
  • Payment: Payments are processed through Stripe (credit/debit cards) or NOWPayments (cryptocurrency). You authorize us to charge your chosen payment method on each renewal date.
  • Price changes: We may adjust subscription pricing with at least 30 days' notice. Price changes take effect at the start of your next billing cycle.
  • Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you retain access to your credits until then.
  • No partial refunds: No pro-rated refunds are issued for the unused portion of a billing period after cancellation.

5. Credits System

MagikVid operates on a credit-based system:

  • 1 credit = 1 second of generated video.
  • Credits are allocated to your account upon successful payment of a subscription or credit pack.
  • Non-refundable: Purchased credits are non-refundable except as described in Section 6 (Refund Policy).
  • No rollover: Unused credits do not carry over from one billing period to the next. At each renewal, your credit balance is refreshed according to your plan.
  • Credits are debited from your account before a generation job begins.

6. Refund Policy

  • Failed generations: If a video generation fails due to a system or API error, the credits spent on that generation are automatically refunded to your account.
  • Subscription cancellation: Cancellation takes effect at the end of the current billing period. No partial refund is issued for the remaining days in the cycle.
  • Unused subscription refund: If you have not used any credits since your most recent payment, you may request a full refund within 7 days of that payment by contacting [email protected].
  • Cryptocurrency payments: Due to the nature of blockchain transactions, refunds for cryptocurrency payments will be processed in the original cryptocurrency at the current exchange rate.

7. Acceptable Use

You agree not to use MagikVid to generate content that:

  • Is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
  • Creates deepfakes or manipulated media of real individuals without their explicit, documented consent
  • Contains sexually explicit or pornographic material (NSFW content)
  • Promotes violence, terrorism, hate speech, or discrimination
  • Infringes upon the intellectual property rights of any third party
  • Attempts to impersonate another person or entity for fraudulent purposes
  • Is designed to spread misinformation or disinformation
  • Violates any applicable local, national, or international law or regulation

We reserve the right to review generated content, suspend accounts, and report illegal activity to the appropriate authorities. Violations may result in immediate account termination without refund.

8. Intellectual Property

  • Your content: You retain ownership of the images you upload and the videos generated through the Service. You grant MagikVid a limited, non-exclusive license to process your content solely for the purpose of providing the Service.
  • Platform IP: The MagikVid platform, including its design, code, branding, trademarks, workflows, and documentation, is and remains the exclusive intellectual property of MagikVid. You may not copy, modify, distribute, or reverse-engineer any part of the platform.
  • Responsibility: You are solely responsible for ensuring that the images you upload and the content you generate do not infringe upon any third-party intellectual property rights.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied.
  • MagikVid shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • Our total liability for any claims arising from or relating to the Service shall not exceed the amount you have paid to MagikVid in the twelve (12) months preceding the claim.
  • We are not liable for any loss, corruption, or unauthorized access to your uploaded images or generated videos.
  • We do not guarantee that the AI-generated output will be free from errors, artifacts, or unintended content.

10. Termination

We may suspend or terminate your account at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms or is harmful to MagikVid, other users, or third parties.

Upon termination: (a) your right to use the Service ceases immediately; (b) any unused credits are forfeited; (c) we may delete your account data, including uploaded images and generated videos, after a reasonable retention period.

You may delete your account at any time by contacting [email protected]. Account deletion is permanent and cannot be reversed.

11. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email or by displaying a prominent notice on the platform at least 30 days before the changes take effect.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Service and cancel your subscription.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Paris, France.
