1. Introduction
MagikVid ("we", "our", or "us") operates the website and AI video generation service available at https://magikvid.com (the "Service"). This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information when you use our Service.
By accessing or using the Service, you agree to this Privacy Policy. If you do not agree with the terms of this policy, please do not access the Service.
2. Information We Collect
2.1 Account Data
When you create an account, we collect your name, email address, and (if you sign in via Google OAuth) your Google account identifier. If you register with an email and password, we store a securely hashed version of your password — we never store passwords in plain text.
2.2 Payment Data
Payments are processed by third-party providers: Stripe, PayPal, and NOWPayments. We do not store your credit card numbers, bank account details, or cryptocurrency wallet private keys. We receive and store transaction identifiers, amounts, and payment statuses from these providers for billing and record-keeping purposes.
2.3 Usage Data
When you use the Service, we collect information related to your activity, including: video generations performed, text prompts submitted, images uploaded for processing, credit transactions, and video outputs.
2.4 Technical Data
We automatically collect certain technical information when you access the Service, including your IP address, browser type and version, operating system, referring URLs, and cookies. This data helps us maintain security and improve the Service.
3. How We Use Your Information
We use the information we collect to:
- Provide the Service — process your image-to-video generation requests, manage your account, and deliver video outputs.
- Process payments — handle subscriptions, credit purchases, referral commissions, and withdrawal requests.
- Improve the Service — analyze usage patterns to enhance performance, fix bugs, and develop new features.
- Communicate with you — send transactional emails (generation status, payment confirmations), respond to support requests, and, with your consent, send product updates.
4. Legal Basis for Processing (GDPR)
If you are located in the European Economic Area (EEA), our legal basis for collecting and using your personal data depends on the data concerned and the context in which we collect it:
- Performance of a contract — Processing is necessary to fulfill our obligations under the Terms of Service, including providing the video generation service and managing your account.
- Legitimate interests — We process data for our legitimate interests such as fraud prevention, service improvement, and security, provided these interests are not overridden by your rights.
- Consent — Where we rely on your consent (e.g., for marketing communications), you have the right to withdraw that consent at any time.
5. Data Sharing and Third Parties
We share your data with the following categories of third-party service providers, strictly as necessary to operate the Service:
- Stripe, PayPal, NOWPayments — Payment processing. These providers receive transaction and billing data necessary to process your payments securely.
- Google — OAuth authentication. If you sign in with Google, we exchange authentication tokens with Google to verify your identity.
- LiroAI — Video generation API. Your uploaded images and text prompts are sent to LiroAI's servers for AI video generation processing. Generated video outputs are returned to us and stored on our servers.
We do not sell, rent, or trade your personal information to any third party for marketing purposes.
6. Data Retention
- Account data — Retained for as long as your account is active. If you delete your account, we will remove your personal data within 30 days, except where retention is required by law.
- Generated videos — Stored on our servers until you choose to delete them. We do not delete your generated content unless you request it or your account is terminated.
- Payment records — Retained as required by applicable tax and accounting laws (generally up to 10 years), even after account deletion.
- Technical logs — Automatically purged after 90 days.
7. Your Rights Under the GDPR
If you are a resident of the EEA, you have the following rights regarding your personal data:
- Right of access — You may request a copy of the personal data we hold about you.
- Right to rectification — You may request that we correct inaccurate or incomplete personal data.
- Right to erasure — You may request that we delete your personal data, subject to legal retention obligations.
- Right to data portability — You may request a machine-readable copy of your data to transfer to another service.
- Right to restrict processing — You may request that we limit how we use your data in certain circumstances.
- Right to withdraw consent — Where processing is based on consent, you may withdraw it at any time without affecting the lawfulness of prior processing.
To exercise any of these rights, please contact us at [email protected]. We will respond within 30 days.
8. Your Rights Under the CCPA
